SMART PUSH MAIL SERVICE
Terms and Conditions


The Subscriber agrees to the following terms and conditions governing the use of the Smart Push Mail Service (“Service”)
1. These Terms and Conditions relate only to Service provided by Smart Communications Inc. (“Company”) and shall be in full force and effect from and after the actual date of approval of the application for the Service.
2. The Subscriber must have an existing personal e-mail address before signing up for the Service.
3. The Service is applicable to all mobile phones that can access GPRS, EDGE, UMTS, 3G, HSPA and even Legacy handsets (“Device”).
4. The Service supports POP (e.g. AOL), IMAP (e.g. Yahoo, Gmail, etc.) and PIM (e.g. Local ISP) e-mails.
5. The Service can support up to two (2) e-mail accounts.
6. The Subscriber must register to http://pushmail.smart.com.ph (web or WAP portal). The Subscriber will be asked to enter a valid e-mail address and password. Enrollment of an e-mail account would mean acceptance of the terms and conditions of http://pushmail.smart.com.ph. Upon successful setup, a mailbox for that e-mail account will be established on the Device.
7. For Legacy handsets, the Subscriber can register to the Service by sending START <email add> <password> to 7077.
8. For Yahoo e-mail accounts, the Subscriber has to visit http://pushmail.smart.com.ph and enroll his account details.
9. Access to URL links that are embedded in the e-mail is not part of the flat rate. Standard browsing charges of P10.00 for every 30 minutes will apply.
10. Postpaid Roaming Subscribers shall be charged the standard VAS roaming charges unless he sent QUIT to 7077 prior to departure from the Philippines to any international destination.
11. The Subscriber shall be liable for all e-mails and other transactions from his Device regardless of who may make such e-mails and other transactions. Non-payment of these bills or refusal on the part of the Subscriber to pay bills arising from these e-mails and other transactions shall be sufficient ground for the Company to discontinue the Service.
12. The Subscriber will receive an SMS notification from the Company one (1) hour prior to package expiration.
13. For inactive users, registration details will be kept in the database for a period of three (3) months, after which, the Subscriber needs to register again his email account details.
14. The Subscriber shall be responsible for ensuring that his personal e-mail/s is/are protected against unauthorized access through his Device.
15. The Company is not liable for illegal/unauthorized transactions that may be performed on the Subscriber’s personal e-mail/s through the use of his Device.
16. The Subscriber acknowledges that account information of his personal e-mail/s will be required for registering to the Service.  This information will not be used for any other purpose except for the purpose of providing the Subscriber with the Service.
17. All other Terms and Conditions of the Smart Gold, Smart Gold Lite, or Smart Buddy subscription, whichever is applicable to the Subscriber, and which are not inconsistent with these Terms and Conditions, shall apply in connection with the Service.
